These Terms of Service govern your use of the Streamify platform and any related services provided by Streamify GmbH

Terms of Service

Effective Date: March 12, 2026

These Terms of Service ("Terms") govern your access to and use of the services, platform, and website provided by Streamify GmbH ("Streamify," "we," "us," or "our"), located at https://streamify.com. By creating an account or using our services, you agree to be bound by these Terms in their entirety.

If you do not agree to these Terms, you must not access or use our services.


1. Service Description

Streamify is a no-code platform that enables businesses and content creators to build, customize, and operate their own white-label video streaming platforms. Our services include:

  • A drag-and-drop website builder for creating customized streaming platform websites
  • A video content management system (CMS) for uploading, organizing, and managing video content
  • Video hosting, encoding, and adaptive bitrate streaming delivery
  • Subscription and one-time payment processing for monetizing video content
  • Custom domain configuration and management
  • Viewer account management and access control
  • Analytics and reporting tools
  • Multi-language support (English and German)

Streamify serves as a platform-as-a-service (PaaS) provider. You, as our customer, are responsible for the content you publish and the platforms you build using our tools.

2. Account Registration and Responsibilities

2.1 Eligibility

You must be at least 18 years of age and have the legal capacity to enter into binding agreements to use our services. If you are registering on behalf of a business entity, you represent and warrant that you have the authority to bind that entity to these Terms.

2.2 Account Creation

To use Streamify, you must create an account by providing accurate, complete, and current information. Account authentication is managed through our authentication provider, Clerk. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Promptly notifying us of any unauthorized access to or use of your account at hello@streamify.com
  • Keeping your account information accurate and up to date

2.3 Organization Accounts

Streamify supports multi-user organization accounts. As an organization owner, you are responsible for managing team members, assigning roles and permissions, and ensuring that all members comply with these Terms.

2.4 Account Security

You must not share your account credentials with third parties. Streamify is not liable for any loss or damage arising from your failure to maintain the security of your account.

3. Acceptable Use

Your use of the Streamify platform is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. You agree to comply with all provisions of the Acceptable Use Policy.

In general, you must not use our services to:

  • Violate any applicable laws or regulations
  • Infringe upon the intellectual property rights of others
  • Distribute harmful, offensive, or illegal content
  • Interfere with the operation of our platform or other users' access
  • Engage in fraudulent or deceptive activities
  • Attempt to gain unauthorized access to our systems or data

Violation of the Acceptable Use Policy may result in suspension or termination of your account.

4. Intellectual Property

4.1 Your Content

You retain all ownership rights to the content you create, upload, or publish through the Streamify platform, including but not limited to videos, images, text, and website designs ("Your Content"). By using our services, you grant Streamify a limited, non-exclusive, worldwide, royalty-free license to host, store, process, and display Your Content solely for the purpose of providing our services to you.

This license terminates when you delete Your Content or close your account, subject to any reasonable technical delay and applicable retention periods described in our Privacy Policy.

4.2 Streamify Intellectual Property

The Streamify platform, including its software, design, logos, trademarks, documentation, and all related intellectual property, remains the exclusive property of Streamify GmbH. These Terms do not grant you any right, title, or interest in our intellectual property, except for the limited right to use our platform in accordance with these Terms.

4.3 Feedback

If you provide us with feedback, suggestions, or ideas regarding our services, you grant us an unrestricted, irrevocable, perpetual, royalty-free license to use, modify, and incorporate such feedback into our services without any obligation to you.

5. Payment Terms

5.1 Subscription Plans

Streamify offers various subscription plans with different features and usage limits. The details of each plan, including pricing, are displayed on our website and within the platform. All prices are stated in the applicable currency and are exclusive of VAT unless otherwise indicated.

5.2 Payment Processing

Payments are processed through Stripe and/or PayPal. By subscribing to a paid plan, you agree to the respective payment processor's terms of service. You authorize us to charge the payment method on file for all applicable fees.

5.3 Billing Cycle

Subscription fees are billed in advance on a recurring basis (monthly or annually, depending on your chosen plan). Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.

5.4 Transaction Fees

If you use Streamify to process payments from your viewers or subscribers, transaction fees may apply as specified in your subscription plan. These fees are deducted from your payouts or invoiced separately.

5.5 Refunds

Subscription fees are generally non-refundable. If you cancel your subscription, you will continue to have access to the paid features until the end of your current billing period. Refund requests for exceptional circumstances may be submitted to hello@streamify.com and will be evaluated on a case-by-case basis.

5.6 Price Changes

We reserve the right to modify our pricing at any time. Price changes will be communicated to you at least 30 days in advance and will take effect at the start of your next billing cycle. Continued use of the service after a price change constitutes acceptance of the new pricing.

5.7 Taxes

You are responsible for all applicable taxes (including VAT) related to your use of our services, except for taxes based on Streamify's net income. We will add applicable VAT to invoices where required by law.

6. Viewer Payments and Payouts

6.1 Processing Viewer Payments

If you use Streamify to sell access to content on your streaming platform, payments from your viewers are processed through Stripe and/or PayPal. You are responsible for setting pricing, managing subscriptions, and complying with applicable consumer protection laws.

6.2 Payouts

Payouts of your earned revenue are made through Stripe Connect or PayPal, subject to the applicable payout schedules, minimum thresholds, and any platform fees as described in your subscription plan.

6.3 Your Responsibility

You are solely responsible for your relationship with your viewers, including customer support, refund handling, and compliance with tax obligations in your jurisdiction.

7. Service Availability

7.1 Uptime

We strive to maintain high availability of our platform. However, we do not guarantee uninterrupted or error-free service. Our services may be temporarily unavailable due to:

  • Scheduled maintenance (with reasonable advance notice where possible)
  • Unscheduled maintenance for urgent security or stability issues
  • Factors beyond our reasonable control (force majeure events)

7.2 No SLA Guarantee

Unless you have entered into a separate Service Level Agreement (SLA) with Streamify, we do not provide any uptime guarantees or service credits for downtime.

7.3 Modifications to the Service

We reserve the right to modify, update, or discontinue any feature or aspect of our services at any time. We will provide reasonable notice for material changes that significantly affect your use of the platform.

8. Data and Privacy

Your use of our services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. By using our services, you acknowledge that you have read and understood our Privacy Policy.

As a platform operator using Streamify to build a streaming platform that collects viewer data, you may be considered a data controller under the GDPR. You are responsible for ensuring your own compliance with applicable data protection laws, including providing appropriate privacy notices to your viewers.

9. Content Responsibility

9.1 Your Responsibility

You are solely responsible for all content you upload, publish, or distribute through your Streamify-powered platform. You represent and warrant that:

  • You own or have the necessary licenses and rights to use and distribute Your Content
  • Your Content does not infringe upon the intellectual property rights, privacy rights, or other rights of any third party
  • Your Content complies with all applicable laws and regulations
  • Your Content complies with our Acceptable Use Policy

9.2 Content Removal

We reserve the right to remove or disable access to any content that violates these Terms, our Acceptable Use Policy, or applicable law, with or without notice.

10. Limitation of Liability

10.1 Disclaimer of Warranties

To the maximum extent permitted by law, our services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

10.2 Limitation of Liability

To the maximum extent permitted by applicable law, Streamify GmbH, its directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, revenue, or data
  • Business interruption
  • Loss of goodwill
  • Cost of substitute services

arising out of or related to your use of or inability to use our services, even if we have been advised of the possibility of such damages.

10.3 Cap on Liability

Our total aggregate liability for all claims arising out of or related to these Terms or our services shall not exceed the total amount of fees paid by you to Streamify during the twelve (12) months immediately preceding the event giving rise to the claim.

10.4 Exceptions

Nothing in these Terms shall limit or exclude liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under applicable law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Streamify GmbH, its directors, officers, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of our services
  • Your Content or the content on your streaming platform
  • Your violation of these Terms or any applicable law
  • Your violation of any third-party rights

12. Termination

12.1 Termination by You

You may terminate your account at any time by contacting us at hello@streamify.com or through the account settings in the platform. Upon termination:

  • Your access to paid features will continue until the end of your current billing period
  • Your Content will be deleted within 30 days of account closure, subject to any legal retention obligations
  • Outstanding payments remain due

12.2 Termination by Streamify

We may suspend or terminate your account immediately if:

  • You materially breach these Terms or the Acceptable Use Policy
  • You fail to pay applicable fees after reasonable notice
  • Your use of the service poses a security risk to the platform or other users
  • We are required to do so by law

For non-material breaches, we will provide you with 14 days' notice and an opportunity to remedy the breach before termination.

12.3 Effect of Termination

Upon termination, all licenses granted to you under these Terms will immediately cease. Sections of these Terms that by their nature should survive termination (including intellectual property, limitation of liability, indemnification, and governing law) will continue to apply.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.

13.2 Jurisdiction

Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Stuttgart, Germany, unless mandatory consumer protection laws provide otherwise.

13.3 Alternative Dispute Resolution

For consumers within the European Union, the European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr/. We are not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board.

14. General Provisions

14.1 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that most closely achieves the intended economic and legal purpose of the original provision.

14.2 Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and Acceptable Use Policy, constitute the entire agreement between you and Streamify regarding your use of our services. They supersede all prior agreements, communications, and understandings, whether written or oral, relating to the subject matter hereof.

14.3 Waiver

Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by Streamify.

14.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

14.5 Force Majeure

Streamify shall not be liable for any failure or delay in performing its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to natural disasters, war, terrorism, pandemic, government actions, power failures, internet disruptions, or third-party service outages.

14.6 Notices

14.7 Language

These Terms are available in English and German. In the event of any conflict between the language versions, the German version shall prevail.
